FREQUENTLY ASKED QUESTIONS:
Additional questions regarding subpoenas may be directed to the Customer Records Work Center in headquarters.
- What should I do if I receive a subpoena for DMV?
Customer service center personnel will no longer be authorized to accept service of process on behalf of the agency. Customer service center managers should refuse to accept a process server's attempt to serve legal documents on the agency, and in turn refer the process server to headquarters. PLEASE NOTE that this will be true only for documents naming the agency as a party and will not extend to service attempts on an employee personally. If the legal documents name you as a party to the suit, you may accept that document on your own behalf. If the Department of Motor Vehicles or Commissioner Lackey is named, you may not accept service of that document. Please advise the process server that you do not have proper authorization to accept the paperwork and advise them that they will need to attempt service at DMV headquarters in Richmond, Virginia. - Process servers attempting to serve legal documents on DMV must now do so only at the security desk at the front lobby in headquarters. The security officers will be provided with a list of authorized individuals, and will call one of those individuals to accept service from a process server.
- Should any employee accept service of process outside of this procedure, they must immediately send an e-mail to customerrecords@dmv.virginia.gov, the Customer Records Work Center in Data Management Services, advising them of the date and manner in which the documents were accepted. The employee should then deliver those documents to court services in Room 514.
- Authorized individuals in headquarters will accept service, hand deliver the documents to the court services area, and confirm delivery of the documents by e-mail to customerrecords@dmv.virginia.gov. An updated list of authorized employees may be found on the intranet under Data Management Services.
